Do I need a lawyer to transfer property in El Paso, Texas?

Texas does not require a lawyer to sign or record a deed, but it does require the deed to be correctly drafted, signed and acknowledged before a notary to be valid and recordable under Texas Property Code Chapter 12 and 13. A defective deed can cloud title for decades. An attorney-prepared deed costs a modest flat fee and is recorded with the El Paso County Clerk the same week.

Can a real estate lawyer replace a title company in Texas?

They do different jobs. A title company issues title insurance and handles escrow; an attorney drafts and reviews the contract, deed, note and deed of trust, explains what you are signing, and fixes title defects the title company flags. For family transfers, owner-financed sales and small deals in El Paso that never go through a title company, the attorney is often the only professional looking out for you.

Will I have to go to court for any of these real estate services?
